Another challenge in asbestos litigation is that the disease often cannot be diagnosed accurately until the late stages of the disease which might be fifty years after the exposure took place. This means that the businesses responsible have often closed or even gone bankrupt due to previous asbestos litigation.

While the litigation is not always straight-forward, the claims which can be awarded are sometimes very considerable, even totaling more than tens of millions of dollars occasionally. Most legal representatives will pursue an asbestos case on a “no win no fee” basis.

As well as for the disease itself, a claim can include amounts for other relevant factors for someone suffering from the disease, including care even if it was not paid for, as well as relevant travel expenses and equipment.
